These Terms of Service (“Terms”) govern your access to and use of the SafetyMind website, web portal, and mobile application (together, the “Platform”), operated by Safety Mind Limited (“SafetyMind”, “we”, “us”, or “our”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. About SafetyMind

SafetyMind provides a digital health, safety, environmental, and compliance management platform designed for construction contractors operating within the United Kingdom.

2. Eligibility

You must be at least 18 years old and authorised by your employer or organisation to use the Platform. SafetyMind is intended for professional and business use only.

3. User Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate and up-to-date information.
• You must not share accounts or allow unauthorised access.
• All activity carried out under your account is your responsibility.

4. Acceptable Use

You agree not to:

• Use the Platform for unlawful or fraudulent purposes
• Upload false, misleading, or inaccurate information
• Interfere with system security or performance
• Attempt unauthorised access to data or accounts
• Upload malicious software or harmful content

5. Health & Safety Responsibility

SafetyMind provides tools to assist with compliance but does not replace your legal duties as an employer, contractor, or duty holder.

You remain solely responsible for:

• Ensuring compliance with UK health, safety, and environmental laws
• Providing safe systems of work
• Training, supervision, and competence of workers
• Accuracy of data entered into the Platform

6. Data & Content Ownership

You retain ownership of all data, documents, and content you upload to the Platform.

By using the Platform, you grant SafetyMind a limited licence to store, process, and display your data solely for the purpose of providing the services.

7. Digital Signatures & Records

The Platform may enable digital signatures and electronic records. You acknowledge that such records may be used as evidence for compliance and audit purposes.

8. Availability & Support

While we aim to provide high availability, the Platform is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free service.

9. Fees & Subscriptions

Certain features may be subject to subscription fees or service charges, which will be agreed separately with clients.

10. Suspension & Termination

We may suspend or terminate access to the Platform if:

• These Terms are breached
• There is suspected misuse or unlawful activity
• Required payments are not made

11. Limitation of Liability

To the maximum extent permitted by law, SafetyMind shall not be liable for:

• Indirect or consequential losses
• Loss of data, profits, or business opportunity
• Injuries, incidents, or regulatory penalties arising from misuse of the Platform

12. Intellectual Property

All intellectual property rights in the Platform, including software, branding, and content (excluding user content), belong to SafetyMind or its licensors.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes are published constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales.
